What to Do After a DUI Arrest in Idaho

The First 7 Days Are Critical

If you have been arrested for DUI in Idaho, the decisions you make in the days immediately following your arrest can significantly impact the outcome of your case. Idaho law creates a narrow window for protecting your driving privileges — and missing that window can mean an automatic license suspension regardless of whether you are ultimately convicted.

Under Idaho Code § 18-8002A, when an officer serves you with a Notice of Suspension after a DUI arrest, you have only seven calendar days to request a hearing with the Idaho Transportation Department to challenge the administrative license suspension. If you do not request this hearing within seven days, your license suspension takes effect automatically.

Understand Your Two Cases

Most people do not realize that a DUI arrest in Idaho creates two separate proceedings:

The Administrative Case: This is handled by the Idaho Transportation Department and concerns your driving privileges. The 7-day deadline applies here. An administrative hearing allows you to challenge whether the officer had legal cause to stop you, whether the arrest was lawful, and whether the testing procedures were properly followed.

The Criminal Case: This is handled by the courts and concerns potential criminal penalties — jail time, fines, probation, and a criminal record. This case proceeds on its own timeline through the magistrate court system.

These two cases are independent of each other. You can win one and lose the other. This is why having an attorney who understands both proceedings is essential.

Steps to Take Immediately

1. Request an administrative hearing within 7 days. This is the single most time-sensitive action after a DUI arrest. An experienced attorney can handle this filing for you.

2. Do not discuss your case with anyone other than your attorney. Statements you make to friends, family, or on social media can be used against you in court.

3. Write down everything you remember about the arrest. Details fade quickly. Document the time, location, what the officer said, what tests were administered, and any other details while they are still fresh.
